The Illinois Supreme Court backed Internet Powerhouse Andy Martin by blocking efforts to remove Governor Rod Blagojevich through the judicial process. Martin asked the Illinois Supreme Court to reject politically motivated efforts seeking to have the court itself remove the Governor. The court backed Martin's interpretation of the Constitution. Constitutional scholar Andy Martin says that due process must be followed, even in the case of persons who are thought to be guilty. He deplores the "lynch mob" atmosphere in Illinois. (CHICAGO)(December 18, 2008) Last week Internet Powerhouse law professor Andy Martin attacked Illinois Attorney General Lisa Madigan for filing a frivolous petition with the Illinois Supreme Court and seeking to use the court as a vehicle to peremptorily remove Governor Rod Blagojevich from office. Martin, a constitutional scholar, petitioned the Supreme Court to deny Madigan's attempt to remove the governor through the judicial process. This week the court agreed with Martin and accepted Martin's interpretation of the Illinois Constitution.
The crusading Illinois corruption fighter continues to demand that Rahm Emanuel step down from any role in an Obama White House: "The stench of Obamagate is spreading," Martin says. "When will 'Barry O' face the inevitable and dump Emanuel? "Emanuel is involved in Blagogate up to his neck. And Obama is involved in Obamagate up to his neck, because it is obvious he is orchestrating a massive cover-up of his manipulation, using the U.S. Attorney's office as a beard. U. S. Attorney Fitzgerald should not allow his office to be used in this manner, because he is also slowly being drawn into the machinations of Obamagate, with obvious implications for a conflict of interest.
"There was some confusion last week as to why I would defend Rod Blagojevich. First, as a matter of policy I do not defend individuals in the public arena. I was defending the Illinois Constitution by seeking to prevent Lisa Madigan's misuse of the Constitution. She and her father are acting as a team of attack dogs. That's not the way the legal system should operate. Daddy and daughter have obvious conflicts of interest. Lisa Madigan's brazen publicity ploy in filing a frivolous petition with the court backfired.
"Second, I was repulsed by the lynch mob atmosphere fostered by the Chicago Sun-Times, Chicago Tribune and other media. Under our system, even a guilty man is entitled to a defense. 'Audi alteram partem' is an ancient common law doctrine, Caritativo v. California, 357 U.S. 549, 558, 78 S. Ct. 1263 (1958)(Frankfurter, Douglas, Brennan, JJ, dissenting) The newspapers were calling for the Governor's scalp without regard to a full and impartial review of the facts. We don't throw shoes in America; we are supposed to be wedded to civility and due process.
"Third, Barry Obama was obviously involved in Blagogate. His people were wheeling and dealing with Blagojevich. Obama is completely responsible for the subsequent cover-up, which we now call 'Obamagate.' This is a classic example of the kind of president Mr. Obama is going to be: scheming, evasive, manipulative and mendacious.
"If Barack Obama has a shred of integrity left, he should stop hiding behind the U.S. Attorney, whom he is also going to taint in due course, and tell the truth and nothing but the truth about his role and Emanuel's role in Blagogate. The 'Chicago Way' of cover-up and corruption will not work in the White House. He must tell the truth. Today.

Your ego far exceeds your importance. Anyone who constantly refers to themself as "Internet powerhouse" is really an Internet powderpuff, Andy. Your obsession with Obama verges on madness. You jump from one defeat to another. Very sad.
Well sadly since the actual Press didn't do it's job of digging up the truth then someone has too!
Besides it will only takes 1 Congressman & 1 Senator to raise the eligibility question. The Georgia Congressman has already pledged to do so. :) Only need a Senator now.
But if they don't pass him by the rules then the SCOTUS can freely move into the process and can & will hear any suits against BHO. And don't forget most if not all of the other cases are still valid, because only their Stay was denied and not the Centori(spl).
Most cases have been denied and if you truly believe the Court will do ANYTHING, you need help. Don't you think that Hillary of McCain would have jumped all over this if there was any substance at all?
The 14th Amendment states that "all persons born or naturalized in the U.S., and subject to the jurisdiction thereof, are citizens of the United States".
Obama was born in Hawaii and there is NO EVIDENCE to prove otherwise. The charge that he was born in Kenya is laughable since his father wasn't in Kenya in 1961 and there is NO PROOF WHATSOEVER that his mother ever visited Kenya.
Dick Cheney, Barry Goldwater, and John McCain all have had their citizenship challenged. None have been declared non-citizens. Berg and the other psychos have ZERO CHANCE of prevailing and anyone who believes they do, needs a quick lobotomy.
Those cases only had the Stay portion denied not the rest of the case. And the SCOTUS is REQUIRED to step in per the Constitution if the Congress does not deal with the any complications of eligibility.
The 14th was also "understood" that a natural born citizen was a citizen from their parents also being citizens being born on US territory's. The cases "Wong Kim Ark" & "Minor" also further reflect this. Especially "Minor" as it states:
” ‘At common law, with the nomenclature of which the framers of the constitution were familiar, it was never doubted that all children born in a country, of parents who were its citizens, became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further, and include as citizens children born within the jurisdiction, without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first. For the purposes of this case, it is not necessary to solve these doubts. It is sufficient, for everything we have now to consider, that all children, born of citizen parents within the jurisdiction, are themselves citizens.’ Minor v. Happersett (1874) 21 Wall. 162, 166-168.”
1 foreign parent + 1 citizen parent = citizen
2 citizen parents = 1 Natural Born Citizen
BOTH cases clearly define the difference between NBC & citizen status.
John McCain & the Socialist candidate were also challenged. Neither was an NBC. Heck the Socialist candidate was taken of the ballot by nearly even state involved in the suits, and McCain had a special session in the Senate confirm his citizenship (which doesn't mean a thing because they can't give NBC status).
“Obama has also failed/refused to release any records pertaining to school, college, and medical. Why? Was he registered as a foreign exchange student at both colleges? A retired INS agent who worked when Obama came into the United States stated he distinctly remembered Obama because of his ‘slick’ manners and speech. The agent says that he went back into the INS files and found the information and that Obama came into the USA on a FS-1 pas sport/visa. FS-1 is a foreign student visa clas sification, not a US citizen passport. So, who out there can get into the INS files and find Soreto/Obama’s record of entry into the USA?“
