Pursuant to HRAP 12.1 and this Court’s Notice dated April 14, 2009, Plaintiff-Appellant files this Statement of Jurisdiction.
1. Statutory basis for appeal
This appeal is filed pursuant to Hawai’i Statutes § 641-1 (a).
2. Timeliness of appeal
a. The Motion for Reconsideration
The District Court announced its dismissal of this action on November 19, 2008. Thereafter, Plaintiff-Appellant filed a timely Motion for Reconsideration on November 26th. The Attorney General filed an opposition on December 12. The District Judge denied the motion on January 27, 2009. The Notice of Appeal was filed on February 13, 2009, well within thirty (30) days from January 27th.
b. The Notice of Appeal
The Notice of Appeal was timely filed within thirty days from the denial of Plaintiff-Appellant’s motion for reconsideration, HRAP 4. (a)(3).
CONCLUSION
With all due respect, Plaintiff-Appellant submits that this Court has jurisdiction of this appeal, and may enter such relief as the record may entitle appellant, Hawai’i Statutes § 641-2.
