Chicago news conference - The University of Illinois faces a lawsuit from corruption fighter Andy Martin if Trustees hand over cash to disgraced Chancellor Phyllis Wise

fighter Andy Martin will hold a Chicago news conference Tuesday,
August 11th to announce he has notified the University of Illinois Board of
Trustees that the school faces a lawsuit if trustees approve payments to
disgraced Chancellor Phyllis Wise. “The University of Illinois and other Illinois institutions are virtual
cash machines for corrupt employees who violate the law and walk away
financially rewarded for their criminality,” Andy says. “Disgraced Chancellor
Phyllis Wise should be discharged with no benefits for conspiring to violate Illinois ’ freedom of information
laws. It is time for Illinois officials to stop shoveling
cash to cooked employees. If the payments are approved I will lobby the
legislature to completely cut off the University from any further state
appropriations. A state in financial crisis should not be rewarding common
crooks just because they are on a university’s payroll.” Andy’s letter to the

Dear Chairman
McMillan:
In my family
we have three (3) degrees from the University of Illinois . I can’t tell you how proud
I am to be an Illinois graduate. I consider it a
great honor to have received two degrees from the U of I (my mother got the
third). But I am deeply distressed and embarrassed by the weak-kneed behavior
of President Kileen and the University’s weak-kneed lawyers who are handing out
cash to reward corrupt employees such as Phyllis Wise.
I am writing
to respectfully request that the Board of Trustees deny Phyllis Wise any
“bonus” for her corrupted years of service to the University and that the Board
consider suing Wise for breach of trust and breach of contract, thereby seeking
to negate her faculty appointment and sabbatical. There is a reasonable basis
to assume that a court would find that Wise breached her fiduciary duty to the
University, and thereby breached her contract, allowing the University to
terminate her contract without further payments.
1. General
legal principles
Generally, the
law favors the settlement of contested legal disputes. Where a bona fide dispute arises, parties
are encouraged to settle. But where is the bona
fide dispute in Wise’s case? Did someone else order her to break the
law? What, apart from published reports, are the facts? Is a cover-up to
protect others in progress? The public has a right to know why the University
is rewarding Wise for corrupt behavior and breach of trust. Was there any
justification for her to violate the law? There do not appear to be any
mitigating circumstances. She willfully, maliciously and wantonly corrupted the
University’s processes to violate freedom of information laws.
Amazingly,
Wise is supposed to get a bonus while Illinois taxpayers are paying a law
firm to investigate Wise’s misconduct. What is wrong with this picture?
Government and
academe are held in low estate in Illinois . It seems like almost a
daily occurrence when some educational institution is paying off some corrupt
employee. Some day, somewhere, someone has to draw the line. I urge you to draw
the line with Phyllis Wise. Enough!
Where is the
incentive for employees to obey the law when the “punishment” for violating and
corrupting the law is a cash bonus, a year’s paid vacation and a cushy job on
return? What message does this settlement send to other potential violators?
In sum and
substance there is no bona fide dispute to settle. Wise is a
crook and faithless fiduciary. Wise broke the law, she should be fired for
cause and the Board should send a stern message to other potential miscreants.
2. Scienter
or intent
If Wise had
made a simple mistake, no one would be calling for her to pay a price. But
there are 1,100 pages of corrupt
emails that she and others acting in concert with her orchestrated to break
state laws.
3. Why is
the University paying off a corrupt employee?
Normally, a
corrupt employee should be fired. Period. Why is the University paying off
Wise? Does she have more dirt to dish on other employees? If the facts are as
they appear to be, Wise should be discharged for cause, not rewarded with a
large payment, vacation and job.
4. Is this
what we can expect from President Kileen?
President
Kileen is off to a bad start. In 1981 when air traffic controllers went on an
illegal strike, President Ronald Reagan fired them. There were no more strikes
by federal employees. President Kileen is starting out his presidency in a very
bad way, by paying Wise hush money to go away and by whitewashing her abuse of
state laws and the public trust.
If Killeen is a marshmallow, that is
all the more reason for the Board to send Killeen a strong, stern message and
stiffen his back: no more buyouts of crooked employees.
5. Preparations
for a lawsuit
While in the
first instance the board votes on this smelly deal, if the board votes to
reward Wise instead of discharging her I will be (a) filing a public interest
lawsuit against the University to suspend the payment and to terminate her contract
and (2) lobbying in Springfield to end all state support for the University.
There is no reason why hard-pressed state taxpayers should be sending their
hard-earned dollars to the U of I to pay lavish salaries to corrupt University
administrators. It is time for the gravy train to end.
