ANDY MARTIN: Chicago court hearing set in Illinois U. S. Senate campaign election appeal
Illinois corruption-fighter Andy Martin says Illinois state election laws violate the U. S. Constitution. A Cook County circuit judge has set a hearing Monday, September 20th at 10:00 A.M. to hear Martin’s appeal of a decision by the Illinois State Board of Elections.

Dear Judge Bertucci:
I received today by fax (emailed fax) an appearance and page-numbered record from Assistant Attorney General Thomas Ioppolo. Mr. Ioppolo’s certificate of service appears to confirm he is delivering a hard copy to me. I am unable to print out a 75-page fax.
If the Court wishes, I can prepare a motion for summary judgment to present on September 20th, since time is of the essence. I do not see that we have any disputed facts in the matter pending before Your Honor, although we obviously dispute the applicable U. S. Constitutional issues as well as the inferences to be drawn from the undisputed facts.
My appeal is narrowly based on the admitted lack of statutory service by the State Board of Elections though I am obviously conversant with peripheral defenses which have been asserted by the respondents.
Unless otherwise ordered by the Court I will be ready to proceed on Monday the 20th at 10:00 A.M.
