New Hampshire News Conference: Conservative blogger Andy Martin seeks Hastert victim files (FOIA)

New Hampshire corruption fighter Andy Martin will hold a Manchester, NH news conference Sunday, June 7th to announce he has asked the U. S. Department of Justice to release the complete file on former Speaker Dennis Hastert’s victims. “I have previously disclosed the hypersexualized environment in the Speaker’s Office in Washington,” Andy says. “Representatives Mark Kirk (now a Senator) and Mark Foley were ‘regulars’ with Speaker Hastert. But what Hastert did as an adult, with other adults, is his business and their business. I completely respect the right to privacy of consenting adults, particularly since Hastert is no longer in office. What Hastert did as a school teacher and coach, is our business, the people’s business. The Department of Justice should release the full file on Hastert’s victims and do so immediately. I have filed a Freedom of Information Act request seeking full disclosure.”

(Manchester, NH) (June 7, 2015) Corruption-fighter Andy Martin, who first exposed the homosexuality aspect of the accusations against Dennis Hastert and has been driving reporting on the scandal since then, will hold a Manchester, New Hampshire news conference today, Sunday, June 7th to announce he has filed a Freedom of Information Act (“FOIA”) request with the U.S. Department of Justice asking that all of the files concerning former Speaker Dennis Hastert’s victims be released.

“We now know of apparently three victims: (1) individual A; (2) Steve Reinboldt (see link below); (3) the person whose family reported the abuse to Representative Mel Watt. Experience tells us there may be many more victims. Given Dennis Hastert’s important role in the U. S. Congress the public has a right to know what the Department of Justice knows about Hastert’s history as a predator. Right now all we have is endless speculation.

Dear FOIA Staff:

I would like to formally lodge a FOIA request for any and all information concerning the identity of “Individual A” in the above case, as well as the identities of any other individuals, in Illinois prior to 1990, excluding the Defendant, who are part of the investigation or file in the above case.

Since Individual A is apparently not being prosecuted, and there is no ongoing investigation about him or her, I believe that FOIA mandates release of any identifying information about Individual A as well as other individuals who were identified and became part of the file concerning the Defendant’s actions in Illinois prior to 1990.

Illinois political expert and Chicago corruption fighter Andy Martin will hold a New York City news conference today, Thursday June 4th to announce he has asked Chicago federal judge Thomas Durkin to step down in the case of former U. S. House Speaker Dennis Hastert. Durkin made two (2) campaign contributions to Hastert’s prior campaigns. “Chicago was recently voted America’s most corrupt city and the federal courts are no exception. They are routinely manipulated behind the scenes. Judge Durkin made two campaign contributions to Hastert’s earlier campaigns. The appearance of public integrity mandates that Durkin step down in Hastert’s case. The case is taking on bizarre overtones, in which Durkin may have had a hand. A week after being indicted, the online docket sheet (as of Wednesday night) still shows no attorney for Hastert. Hastert is certainly taking the criminal charges very casually. The American people have a right to an honest proceeding, not one governed by the “ancient common law writ of ‘fixicatus’ in Chicago courts.”

Andy says the fact that the federal judge, while still in private practice, made campaign contributions to two of Hastert’s campaigns destroys the appearance of integrity and impartiality

(Chicago) (June 4, 2015) Long-time Illinois and Chicago corruption fighter Andy Martin will hold a New York City news conference today, Thursday, June 4th to announce he has asked the Chicago federal judge in former U. S. House Speaker Dennis Hastert’s criminal case to step down. Judge Thomas Durkin made two (2) campaign contributions to Hastert’s campaigns while Durkin was still a private attorney. [A copy of Andy’s letter to the judge is available upon request.]

Although Durkin was appointed by President Obama, Andy says that Durkin was probably promoted for the federal appointment by a Hastert crony, “closeted” U. S. Senator Mark Kirk. Kirk and Senator Dick Durbin have shared appointments to the federal courts.

Andy is due back in Chicago next week.

“Tom Durkin may be as pure as the driven snow,” Andy charges. “But, to mix a metaphor, the tablecloth of justice is irreparably soiled by the appearance of impropriety in having Hastert’s case heard by a crony of Mark Kirk, who was linked to the homosexual shenanigans in Hastert’s congressional office.

“I strongly disagree with NYU law professor Stephen Gillers that it is ‘ok’ for a federal judge to hear a criminal case where he has previously made a campaign contribution to the defendant [see politico.com link blow]. As an adjunct professor of law, I am confident that a criminal case is not, as Gillers suggests, a private lawsuit where the wishes of the parties prevail and where they can waive ‘conflicts.’ Rather a criminal case is quintessentially a public proceeding in which the public has an overriding interest in seeing that justice is administered without favor. Gillers is just flat wrong.

“This year I ‘celebrate,’ if that is the term, fifty (50) years of corruption fighting work in Chicago and Illinois, and national politics. I went to the Illinois General Assembly in 1965, and later that summer went to Capitol Hill to research a thesis on U.S. Senate rules and procedures.

“If you had told me fifty years ago that half a century later I would still be standing up against corrupt federal judges and rigged criminal cases in Chicago, I would have said ‘no way.’ I laid the groundwork for Operation Greylord, which exposed corruption in the courts, and I helped send mobsters and Daley Machine thugs to federal prison. But even though I left Chicago years ago, I promised to keep an anti-corruption presence in the city and state. I think I coined the term ‘ancient common law writ of fixicatus’ to describe the way justice was and still is ‘fixed’ in federal and state courts.

“I have advised the judge that there are a number of avenues open to me to challenge him if he tries to stay in the case, including a petition for mandamus in the Court of Appeals and a request to the Judicial Council.

“You can already see the way Durkin is favoring Hastert and allowing Hastert to treat a criminal indictment as a light matter. Wednesday night (June 3rd) I checked the online docket for the federal court. Despite a published report that Hastert has an attorney, the online docket sheet still shows no appearance of counsel for Hastert. Have you ever heard of a federal criminal defendant who, a week after being indicted, still has no attorney and the judge simply extends the arraignment date? Not often.

“At least one Illinois newspaper shares my concerns (see link below)

“Adding to my concerns, that Hastert is already getting special treatment from Judge Durkin, is that I know why Durkin is coddling Hastert. Durkin doesn’t want to irritate the senators, who could nominate him for a promotion to the Seventh Circuit Court of Appeals. That’s the way the judicial game, and the political game is played in Chicago.

“I have been fighting corruption for half a century and as my latest efforts reflect my energy and my commitment to public integrity and justice are undiminished. Durkin must go. As for ‘perfesser’ Gillers, he needs to take a refresher course in judicial ethics.
