New Hampshire corruption-fighter and maverick Republican Party activist Andy Martin was in Strafford County Superior Court Thursday afternoon as an electric confrontation unfolded between the executive, legislative and judicial branches of New Hampshire government. Superior Court Justice John Lewis granted Andy status as an amicus curiae and postponed a decision on Andy’s motion to intervene. The “student voter” lawsuit now heads to the New Hampshire Supreme Court as the high-stakes, high-profile conflict continues. The Strafford County case could determine the outcome of a close presidential election, Andy says

Sharp exchanges mark the 2-1/2 hour hearing Thursday afternoon on student voting



(Manchester, NH) (October 5, 2012) “In the forty-four years since I first walked into a courtroom as a public interest litigant, I have almost never seen anything quite like what I witnessed in the Strafford County Superior Court on Thursday,” Andy Martin observes.



“The Strafford County Courthouse is a 1970’s brick and glass moderne structure that sits on a site that is barely removed from being a pasture. Across the street is the county jail and probably in earlier years the county farm (the courthouse is on County Farm Road).



“The superior court justice was whip smart and interested in doing the right thing.



“The dry Associated Press report (link below) which concentrates on Secretary of State Bill Gardner’s affidavit, does not do justice to the drama which unfolded.



“Originally scheduled for an hour, the hearing lasted two and a half hours. There was a battle royal, or maybe just a giant food fight, between the three branches of New Hampshire government.



“The court began by considering three motions to intervene in the case. The court questioned the authority of the Speaker of the New Hampshire House of Representatives to intervene as a party; the Speaker was granted amicus curiae status. A vigorous exchange characterized the Speaker’s and the justice’s consideration of the intervention motion.



“Then another intervener was heard, and his motion was denied (and later converted to “ruling deferred”).



“My motion to intervene was then heard by the court.



“The court granted me status as an amicus curiae. After some argument about what was the proper procedure, the justice decided to defer a ruling on my motion to intervene. I was seated at counsel table and the hearing on the merits of the controversy began.



“In what was an unusual scene, the justice began asking the attorney general if he could adequately represent the secretary of state. The justice then addressed the secretary of state directly, and the secretary asked for a time out. Surreal.



“Eventually, Secretary of State Bill Gardner answered the court’s questions for what seemed like an extended period.



“Later there was another sharp exchange between the justice and the Speaker’s counsel.



“The justice appeared to be concerned that the initial hearing in the case held in mid-September might not have been sufficiently adversarial and sufficiently informative for the court. As this is written I have not yet seen an amended order from the justice but I expect one to appear some time Friday.



“My principal contribution to the proceedings was to support the judge in his searching inquiry questioning the plaintiffs ‘standing’ to file the lawsuit, and my succinct discussion of the relationship between ‘standing’ and the court’s subject matter jurisdiction. I will be filing a very informative motion of my own in the Supreme Court on Friday.



“All in all the hearing in Dover was one of the most adversarial and confrontational I have ever seen.



“The constitutional issues are profound. The State House believes the legislators changed the law and did so clearly. There is strong legal authority for that view. Secretary Gardner and I believe the House wanted to end ‘dual domicile,’ which creates a conflict between general residency and voting domicile. As the hearing continued the issues became more complex.



“No one can predict what a supreme court will do. But here is my best guess. I believe the court will accept the new law, accept the amendments and endorse the House’s view that it intended to and did end ‘dual domicile.’ I believe Secretary Gardner and I will prevail on that position. In the meantime, we could see a slugfest next week.



“Fasten your seat belts. This is not a dull case and the hearings are not boring. I have seldom seen such electricity in a courtroom.



“And, hovering over the proceedings is former president Bill Clinton’s exhortation to students at UNH Wednesday afternoon to flood New Hampshire polling places with liberal out-of-state voters.



“Every New Hampshire voter and every New Hampshire taxpayer has a vital interest in the outcome of this lawsuit. Whatever the bland news reports may say, this was an electric hearing Thursday afternoon. Expect more voltage on all sides,” Andy believes.

New Hampshire news: Andy Martin was for Mitt Romney before the first debate October 3rd

Anti-Obama leader, New Hampshire corruption-fighter and maverick Republican Party activist Andy Martin was pro-Romney before the first debate. When media bobbleheads were hand-wringing over Romney’s campaign in mid-September, Andy stood up and said he was “strongly behind the Romney presidential campaign” and announced the formation of “Romney’s Rangers.” Andy has been battling in court to block Barack Obama from stealing New Hampshire’s electoral votes by trucking in out-of-state “students” from New York and Massachusetts. “It’s easy to join a winning wave, the day after a strong debate,” Andy says. “It took guts and character to stick with your candidate when Republican and conservative crybabies were ready to write off Mitt Romney last month.” I am proud to have been for Romney before October 3rd. Good job, Governor.




Wednesday afternoon, former President Bill Clinton let the cat out of the bag by attacking Andy’s efforts to block out-of-state voters. Now we know who’s really behind the Strafford County lawsuit.

Wednesday President Bill Clinton attacked Andy’s efforts



(Manchester, NH) (October 4, 2012) Mitt Romney will have a lot of new friends this morning.



I won’t be one of them.



I was already for Romney – before October 3rd.



On September 21st (see link below) I announced the formation of “Romney’s Rangers.” I said “There is no choice but to “Stand up for Romney and I am very proud to stand up with Mitt Romney as our presidential candidate.”



So, today I am extremely proud at Romney’s debate performance. It was a great debate. Both candidates gave it their best. But Romney’s “best” was better than Obama’s “best.” The long faces at MSNBC could not conceal their disappointment at President Obama’s showing. I was particularly fascinated by Ed Schultz, who is a strong liberal but often tells the truth about the state of the fight. Schultz was despondent with Obama’s performance.



As I said on September 21st, no candidate is perfect. But I had confidence in Mitt Romney because I have studied his campaign for the past eighteen months. During the primaries I was often critical of the other candidates. But I saw a future president in Romney. Republicans needed a winner. Romney could win. I believed he could and would. And will.



So today I am exultant at Romney’s preparation, his presentation and his total performance last night.



For my part, I have been tirelessly battling on Romney’s behalf. I am very proud to have been the first and so far the only Republican to stand up against a bogus lawsuit filed in Strafford County by Obama supporters to flood New Hampshire with liberal out-of-state voters. Wednesday afternoon former President Bill Clinton attacked my efforts (link below). (State House Speaker Bill O’Brien later sought to intervene in an official capacity, but not as a partisan). I am an openly Republican battler against the phony “Democrat v Democrat” lawsuit that was filed to legitimize out-of-state voting.



Mr. Romney realized Wednesday night that he needed to broaden his presentation. He spoke of his record as governor. Romney accomplished as governor of Massachusetts what he is promising to accomplish as president of the United States. Romney is not only a “businessman.” He is a candidate who rescued the Olympics. He is a candidate who proved he could be a successful chief executive in the Massachusetts governor’s office. Romney performed and produced for the people of Massachusetts. He can perform and produce for the American people in the White House.



At a time when nervous “conservatives” were writing off Mitt Romney, in mid-September, I stood tall with our party’s candidate. I’m even taller for him today. And of course every early Romney backer welcomes Mitt’s new post-October 3rd supporters.



No party and no candidate is perfect. We all have our faults. But Romney is the man we need in the White House. I totally believe Ann Romney when she says “Mitt will not fail.”



President Obama is absolutely correct that this is a “choice” election. Americans have a choice between a growing federal government influence in our daily lives and the constitutional conservatism of Mitt Romney and faithful Republicans.



Governor Romney showed he will not abandon those who need help; “We will leave no American behind.” But Romney will also provide incentives for those who want to take risks and “dream big.” Obama dreams of a bigger and bigger government making more and more decisions in our daily lives. Conservatives want an America that helps those who need help without discouraging those who can perform and produce economic opportunities which benefit all of us.



Thursday afternoon I will be in court in Strafford County protecting every New Hampshire ballot box. Bill Clinton can’t scare me off. In fact, if anyone doubted who was behind the bogus “voter” lawsuit, Clinton let the cat out of the bag: the failed Obama/Clinton administration. Wednesday afternoon Clinton made explicit what had hitherto been implicit: the Strafford lawsuit is a partisan maneuver to transfer votes from liberal “Obama base” states to conservative battleground state New Hampshire.



I will be working to ensure that New Hampshire voters do not see their votes diluted by these out-of-state “voters.”



Obama’s supporters tried to pull a typical Chicago-style fast one by stuffing New Hampshire ballot boxes with out-of-state votes. I was standing guard for the people of New Hampshire to block Obama’s scam.



I am proud to stand tall with Mitt Romney.



I will do everything in my power to make Mitt Romney the next president of the United States.

New Hampshire: How Andy Martin may have rescued Mitt Romney’s presidential campaign

Anti-Obama leader, New Hampshire corruption-fighter and maverick Republican Party activist Andy Martin is not the Republican Party’s favorite guy. But Andy’s surprise appearance in a Democrat v Democrat lawsuit in Strafford County, New Hampshire may have rescued Mitt Romney’s presidency and also helped the Republican candidate for governor, Ovide Lamontagne. Andy became the first Republican to appear in the Strafford case to prevent out-of-state ballot box stuffing by President Obama’s campaign. (SEATTLE) (October 2, 2012) OK, let’s start with the obvious. I am not one of the Republican Party of New Hampshire’s favorite leaders. The publisher of the Union Leader Joe McQuaid has called me a “hot dog.” The Associated Press in Concord recently suggested I live in dreamland. I could go on, but you get the idea.



But maybe they’re the ones living in dreamland.



Oh, and I am not on Mitt Romney’s speed-dial.



But maybe I ought to be.



Recent legal action that I initiated may do more to put Romney in the White House than anything else being organized by New Hampshire Republican Party leaders. Here are the facts: you be the judge.



A number of students recently filed a lawsuit in Strafford County Superior Court. The plaintiffs were represented by the usual array of “civil liberties” suspects. It’s a free country; they had a right to file their lawsuit.



The case claims out-of-state students have a “constitutional right” to vote in New Hampshire instead of their home states where they hold driver licenses and register their cars.



Why are out-of-staters so intent on voting in New Hampshire? New Hampshire is a swing state; the student vote could help swing the election to Obama. If students (or others, since the lawsuit seeks to open the floodgates to out-of-state voters, not just students) come from New York or Massachusetts, for example, Obama is going to win those states overwhelmingly. In New York and Massachusetts, their home state votes would be meaningless. In New Hampshire thousands of out-of-state liberal votes could be decisive in the presidential and gubernatorial elections. That’s why the “students” are so desperate to vote in New Hampshire and not in New York or Massachusetts.



The Republican Party of New Hampshire did not seek to intervene and be heard in the Strafford proceedings.



Instead, the lawsuit was “defended” by Attorney General Michael Delaney, appointed by the lame duck liberal Democratic Governor, John Lynch.



And so here was a lawsuit filed by liberal Democrats being “defended” by an office that is controlled by liberal Democrats, seeking to open the floodgates to out-of-state voters in New Hampshire.



That is, until I showed up in court and said “Whoa, this case smells like a Chicago-style plot by Obama’s operatives to stuff New Hampshire ballot boxes with out-of-state votes.”



History may have been changed.



I filed my intervention papers to be heard on Monday morning September 24th. Monday afternoon, the Strafford County justice entered an injunction allowing out-of-staters to vote in New Hampshire. I was scheduled to leave for Honolulu at 6:00 A.M. Tuesday morning the 25th. I could have easily said, “Can’t do it; too busy with the Honolulu trip (investigating Obama) to respond to the judge's order.” But, recognizing the importance of this lawsuit and its potential to damage Romney and Lamontagne, I stayed up all night preparing an appeal of the injunction order. I actually deposited the appeal papers in the FedEx drop box in Salt Lake City where I changed planes. The appeal was received by the New Hampshire Supreme Court on Wednesday the 26th.



In a latter day version of the ride of Paul Reverse I had sounded the alarm about a potentially collusive lawsuit that could swing the state of New Hampshire to Obama using out-of-state voters.



Nate Silver of the New York Times has posited a way the electoral votes could be deadlocked (link below). New Hampshire is a crucial piece of the Romney strategy. The presidency could well turn on who wins new Hampshire. (That is why, in another prescient move, I announced in August that I would limit my fall campaign activity to New Hampshire and Nevada.)



But other than my independent Super PAC “Romney’s Rangers,” and my own formidable litigation activity, what are New Hampshire Republican leaders doing? You'll have to ask them. National ads from the Romney campaign and Super Pacs do help, of course.



But Obama’s people are cunning and ruthless. To demand that students who can vote at home were being denied a “constitutional right” by New Hampshire election authorities is a bold strategy calculated to stuff ballot boxes in a swing state. I was the first Republican to stand up and say “Stop.” To date, the only Republican.



If I had not filed to intervene to block this giveaway, and had not spent all night preparing an appeal to the Supreme Court, thereby forcing the Attorney General’s office to file their own face-saving petition, the Democrats might have walked away with winning New Hampshire without a fight.



And so I have this question for Joe McQuaid: am I a hot dog … or a big dog? Who in the Republican Party is fighting harder and more skillfully than I am to put Mitt Romney in the White House?



Facts are stubborn things. Until I appeared in the Strafford case the Democrats were “litigating” with Democrats. Now the New Hampshire Supreme Court is likely to make a major constitutional pronouncement. My legal maneuvering may have salvaged New Hampshire for Mitt Romney, and therefore saved Romney’s presidency.



Strange but true.



Bottom line: I came home to New Hampshire to honor my grandparents who immigrated to Manchester 100 years ago. I hope you will agree I am doing my best to redeem their legacy and to repay New Hampshire’s great gift to my family.

’ of New Hampshire political corruption and insider dealing,” Andy says. “The Balsams was illegally handed over to two real estate hucksters that had no intention of reopening The Balsams and had every intention of destroying the property. The Balsams was a going concern that was employing hundreds of local North Country people in a rough economy. Today the business is destroyed, the property is endangered and the historic contents were destroyed in an ‘auction.’ I have taken action to try to undo this travesty of ‘trust supervision’ by Governor Lynch and Attorney General Delaney.”

Andy says the New Hampshire Attorney General unlawfully and fraudulently approved a sale of “The Balsams” to real estate speculators and hucksters that are systematically destroying the hotel and never had any plans to reopen the facility



Andy calls the Neil Tillotson Trust/Tillotson Corporation a “Peyton Place” of New Hampshire corruption



Andy has become New Hampshire’s only public interest lawyer by default



(CONCORD, NH) (July 6, 2012) New Hampshire corruption fighter and conservative blogger Andy Martin, who by default has become New Hampshire’s only public interest lawyer, announced today (Thursday) that he has filed suit to undo the sale of New Hampshire’s historic grand hotel The Balsams. Andy charges the “sale” of the Balsams was tainted by corruption and insider dealing.



The suit was filed in Merrimack County Superior Court, has been served on the defendants and process has been returned to the Clerk’s office. Among other relief the suit seeks to undo the sale of the overall property to Daniel Hebert and Dan Dagesse, Jr.



“The more I looked into the sale of The Balsams the more it smelled,” Andy says. "The media were asleep and no one in New Hampshire is organized to fight local corruption. Hebert and Dagesse never had any intention of reopening The Balsams. A priceless North Country resource is being raped and destroyed by these real estate hucksters/speculators.



“The recent ‘auction’ of The Balsams contents was an effort to ensure the hotel never reopens as a family-oriented facility.



“Governor Lynch and Attorney General Delaney eliminated 300 North Country jobs. They are two of the biggest job-destroyers in recent New Hampshire history.



A copy of the lawsuit is attached to emailed copies of this news release.



“I have consistently accused the New Hampshire Attorney General of fraud and incompetence in his regulation of the Tillotson Trust and eventually I am going to ask the Court to appoint a special prosecutor to investigate this mess.



“We know as a fact that Attorney General Delaney conducted his ‘review’ proceedings in secret, received no input from the public, and allowed a priceless North Country resource to be sold in the dark of night to a couple of hucksters and speculators. That is not the way public trust assets are supposed to be handled. The whole transaction smelled from start to finish.



“Are we to understand this is how public trusts are ‘regulated’ in New Hampshire? The rape of Neal Tillotson’s trust is a public disgrace.”
