I save a woman’s life, on the worst night of my life

Republican Party Presidential Candidate and conservative columnist Andy Martin says reports of the attack on Lara Logan reopened memories of a similar incident in Iran 32 years ago. Martin took time off from preparing for his upcoming trip to New Hampshire to reflect on an event that reshaped his life. Here is his flashback.

The Logan incident reopens painful memories for Andy

(NEW YORK)(February 17, 2011) Once in a blue moon a news report hits me in the heart. I have been exposed to so many experiences that sometimes experience just bounces back and smacks me in the face. Memory is a difficult quality to discard. I had an eerie remembrance reading reports of the attack on CBS News’ Lara Logan in Cairo. Logan thought she was in a celebratory environment and thus was probably surprised when she was attacked.

I saved a woman’s life on the worst night of my life.

In 1979 I was in Iran during the hostage crisis. I was tipped off that something had happened in Tabriz, a remote city in Azerbaijan Province. Together with a reporter from Associated Press, Alex Efty, and a Miami Herald scribe, Guy Gugliotta, we decided to travel as a group to Tabriz.

Flying to Tabriz I sat in the cockpit jump seat with the Iran Air crew. It was a scary insight. The co-pilot said that Iran was training suicide bombers. If Iran was threatened they would strike back at America. I didn’t know what to say. Because I had trained briefly as a military pilot, we spoke as pilots and not as people discussing politics. But it was still uncomfortable being in that cockpit. Finally we landed in Tabriz. Alex, Guy and I headed for a hotel.

Just beyond the hotel, a mini-revolt was in progress about half a mile away. Anti-Ayatollah Khomeini forces had taken over the local TV station which sat on a hilltop. While we cased the station thousands of pro-Khomeini demonstrators stormed the facility and retook it. We were engulfed with people who wanted to know why we were there.

That night I received a tip that something was brewing at the Government House. I think the term “Government House” is best described as a local municipal building, perhaps a county courthouse or office building.

Little did I know that the worst night of my life was about to unfold.

When we got to the facility a source led Alex and me into the building. I still remember the screaming and the cries coming from the second floor to the angry crowd in the front yard. Perhaps five hundred people were outside in front of the building, armed with rifles, pistols and automatic weapons. They were chanting. They were whipping themselves into a frenzy to counterattack the TV station. Over a dozen men were to die that night in firefights on the hill.

Finally my guy came back and said the building was about to explode, and we had to get out. The crowd was being herded up to the TV station. Alex and I moved out on to the front steps of the building to watch. The steps were about six feet high and gave us an overview of the ground where the crowd was still yelling and screaming. We hesitated and looked out at the mob. The men were getting increasingly agitated as they prepared to launch their counterattack.

Out of the corner of my right eye I saw a woman. I recognized her visually but didn’t know her name. I had seen her earlier in the day at the hotel. She had a camera crew. As I remember she had three men with her, rather smallish types. She had a pale complexion, reddish hair and was wearing a white coat. The white coat sticks out in my memory. She walked on the periphery of the mob trying to find an opening into the crowd for an angle shot.

Suddenly the men in the mob discovered her. They grabbed her and she started screaming. The screaming was piercing.

In a moment, Alex’s eyes and mine met. His look said, “I’m too small to rescue her. It' you.” Somehow I made a flying leap off the steps into the crowd. I don’t remember that second.

I remember swimming in a sea of humanity, using my arms push forward towards the screaming woman. If you are familiar with the Lara Logan episode last week you can see why her incident triggered these memories.

Finally I pushed my way through the crowd and grabbed the woman in a bear hug, face-to face. I said something, probably “Don’t worry, I’m here.” She kept screaming.

I was scared she might think I was one of her attackers. Seconds became years. I drifted a few feet away, as though floating in violent river rapids. She kept screaming. Each second was like a lifetime. My mind snapped to. I realized she had lost control and was in a breakdown state. The more she screamed the more agitated the crowd became. I swam back to her and grabbed her a second time.

She kept screaming. Slowly I maneuvered her to the side of the mob. Her crew was on the side, outside the crowd, as though on a bank trying to reel her in from the raging river. We got her out. I was alone with the woman and her crew, in the middle of a smaller mob that was still following us.

We started to walk through what appeared to be a garden, towards a car NBC News had rented. Somewhere along the line someone told me she was with NBC News. The woman was Hillary Brown.

Alex and I were separated.

As we approached her car, her men got in and I helped her in. She had stopped screaming as we walked through the garden.

But the car was now surrounded by a potentially hostile mob. Again I looked inside myself. What to do?

In an instant, I started screaming at the top of my voice: “Death to the Shah! Death to Carter.” The crowd was flummoxed. Then they joined in. “Death to the Shah! Death to Carter!” In the confusion the driver saw an opening and drove off to the hotel where all of us were staying.

I think my guy drove me back to the hotel; I don’t remember how I got there or when I reunited with Alex. The night had become totally insane.

But the terror was only beginning.

There was relentless small arms fire. From the hotel windows you could see tracers going towards the TV hill, and tracers coming back from the station.

The street outside the hotel was filled with trucks, packed with people driving to the TV hill. They had more rifles, more pistols, more automatic weapons. I looked at myself and said truly this is madness.

Alex wandered towards the gunfire at the entrance to the TV hill. After hesitating, I went after him to be sure he could get out.

By the time we got back to the hotel the gates were locked and we had to climb the fence to get in.

I tried to get on the telex machine but Pranay Gupte of the New York Times was monopolizing the telex. I waited.

And then disaster struck.

Two men approached me. One said I was under arrest as a spy. The other one had an M-16. With his rifle he pointed for me to go outside. I hesitated, but politely. The men spoke no English and I spoke no Farsi. I asked the hotel clerk to tell them we should stay inside where he could interpret. Amazingly, they agreed. The senior of the two said he was a komiteh, a sort of neighborhood vigilante. He said he had witnessed me orchestrating the battle. Utter nonsense. Very politely I told him he was incorrect. But there was no way to reason with him.

He wanted to take me somewhere, outside the hotel compound. I resisted. Again very politely. I knew if I left the hotel I was dead. I realized that with all the gun fire and automatic weapons relentlessly punctuating the darkness people were dying. This man was trying to blame me. I was in dire danger.

Because Gupte was monopolizing the telex I kept stalling the men and asking the desk clerk to tell them to wait because I had to send a telex to let people know I was under arrest. I don’t know how long the komiteh waited. Every second took forever to pass.

Finally, the men got irritated, then tired of waiting. They grabbed my identification and said I had a forged ID. They promised to return in the morning.

I spent the entire night terrified of what would happen the next day. Should I run? Of course not I said to myself. There was no way to escape Tabriz. The city was isolated. I was trapped.

Pranay and his lady friend eventually helped calm me down.

Next morning the komiteh returned and tried to take me away again. Alex, who was not under arrest, started yelling at the man. The komiteh opened his coat and showed a pistol. He told the desk clerk to tell us that unless Alex shut up, the komiteh would shoot both of us. I thanked Alex and said “Please let me handle this.”

The episode then took on an Alec Guinness air. I told the komiteh, “I’m happy to go with you, but if you are a policeman, you need to have a police car. So I can leave with you in the police car.” He looked puzzled for a moment; he made a call. Shortly a police car arrived and took us to the local police station.

The police profusely thanked the komiteh and said they would take it from there. The komiteh left.

After calling Tehran, the police handed back my identification and said I could leave. They drove me back to the hotel. Alex told me he wanted to do a story on the daring rescue he had witnessed but Hillary Brown killed the idea because it would damage her career. I found out they were friends and both lived in Cyprus.

Hillary had no idea she had cracked in the crowd. She had no idea of the risks she had created for herself or her crew. She had no idea how close she had come to being killed by the mob. And she was angry at me for rescuing her and saving her life.

I learned over a dozen men had died the night before.

Word of the massacre spread to Tehran. People started streaming in to witness the aftermath. My life-threatening night of terror slowly became something of a lighthearted matter. Friends joked, “We don’t care if you are a spy; we still like you.” Gee, thanks.

A Japanese cameraman, Mr. Nagasaki, came up and said “You Jamesu Bondu.” “Thank you,” I said, not knowing what to say to that encomium.

The hotel staff told me I was booked on a flight to Tehran. I headed for the airport. Faster, faster I said silently.

I had no idea yet that the night had changed my life in ways I could not yet anticipate. I would be coming back to Iran. My escape from Tabriz would lead to new dangers in the days ahead.

A few weeks later I returned to Iran, alone, still during the hostage crisis, and linked up with the mujahideen in Afghanistan who were fighting the Soviet army. Maybe I was in as much danger in Afghanistan, or even more danger, but I was never in as much fear as that night in Tabriz. That night has stayed with me.

I have had horrible experiences since them. But never in my life have I felt so vulnerable, so afraid of being close, too close, to death. And yet, if I hadn’t been in that place, the woman might have died. Thankfully, she didn’t.

That night has made a difference in my life. More about the incident later, someday. Maybe.

Postscript. Years after the Tabriz rescue, I was at a dinner in New York with a date. We were seated next to CBS' Mike Wallace and his wife. My date thought of me as being kind of quiet, maybe too cautious. As the dinner was ending a woman came up to me and threw a glass of wine in my face. It was Hillary Brown. She was still angry that her rescue had precipitated an incident. I suppose Hillary will go to her grave angry at me, because she has no idea what happened on a fateful night when she could have died.

Thankfully, I was there to save her.

It was the worst night of my life.

The 2012 presidential campaign begins in Honolulu on November 9, 2010. Barack Obama fooled a lot of voters in 2007-2008. He won’t fool the American People again in 2012.

Our November 9-16, 2010 Honolulu meeting is titled: Obamacon 2012

The “Third National Conference on Barack Obama’s Missing Birth Certificate, College Records and Religion” will be a landmark in American political history. Never before have ordinary Americans prepared in advance to legally remove an occupant of the White House due to serious questions about his eligibility to serve as president.

Because I have always limited myself to searching for the truth and finding the facts about Barack Obama, I enjoy worldwide credibility as the first investigative scholar on Barack Obama’s early years. I believe it is inappropriate to attack Obama with anything less than the facts and truth. My book on Barack Obama, “Obama: The Man Behind The Mask” continues to sell through the publisher [OrangeStatePress.com] because it is an attempt to get at the truth behind Barack Obama.

As a result of the efforts which I began in 2004 to shed light on Barack Obama’s family history, nearly 100 millions have eventually come to have doubts about Obama’s credibility.

We are the most spontaneous political movement in American history.

All of you want to discuss and review developments in 2010 concerning Obama’s birth, high school/college/law school records and religion. That’s why we organized the Third National Conference for November 9-16 in Honolulu, the supposed “birthplace” of Obama, although Hawai’i officials continue to refuse to release his original 1961 birth certificate.

Why does Obama persist in refusing to release his original typewritten 1961 Hawai’i birth certificate? Why does he refuse to release any of his Punahou School (Honolulu private school) records, his Occidental College records, his Columbia University records or his Harvard Law School records? Obama’s says “trust me.” Nearly 100 million Americans do not.

1. Location

The conference will be held in Honolulu November 9-16, 2010. We plan a number of sessions over that period, as well as ample opportunity for you to conduct your own investigative activity and familiarize yourself with the Obama myth.

Obama saboteurs stole the tapes of our first National Conference in Washington, DC. We will ensure they do not steal the tape of Obamacon 2012. For some reason, Obama and his associates are terrified of the investigative work we do on his personal history. What is he hiding? What doesn’t he want us to find out?

2. Hawai’i freedom of information materials

We are still fighting in court to release Obama’s birth records and Hawai’i state records on the political cover-up orchestrated by Hawai’i Democrats.

3. Conference Registration fee and ID requirement

As always, we need some advance indication of how large the attending group could be to make space-planning decisions. Therefore, we have added a nominal $50 advance registration fee which covers all sessions. Please fill out the attendance form and mail it back with the $50 to arrive in New York before November 8th. Please include a copy of a photo ID so we can confirm your identity when you arrive at the conference. (In order to enhance security there will not be any “at the door” registration.) Once we know how many to plan for, we can work out how formal or informal to be.

We are currently scouting meeting options in Honolulu. We will notify you by e-mail as to the locations. You can also follow developments on our blog. We will be using our original blog, http://nationalconferenceonobama.blogspot.com/, for the third time.

4. Conference agenda

In the near future you will be receiving the first draft of our proposed agenda. You are invited to begin submitting suggestions, comments and proposals for any future revisions.

5. All are welcome—but please bring evidence, not illusions

Anyone is welcome to register and attend our conference. But please, if you want to express a theory, bring some rational, tangible evidence to support your claims about Mr. Obama. Those of you who know me know I am committed to working only with accurate information and, as we lawyers say, “reasonable inferences drawn from the available facts or available documentation.”

Pie-in-the-sky will not fly. Hucksters who use bogus documents to obtain anti-Obama publicity only undermine legitimate inquiries into Obama’s opaque past. We need to search for the truth and look for the facts.

6. Security

We will have adequate arrangements for security in case Obama’s desperate sycophants try to disrupt us again.

7. Media

Media are welcome to register. We will be providing twitter.com updates during the conference (twitter.com/AndyMartinUSA).

8. Visitors to Honolulu

We selected November 9-16, 2010 for the conference because the dates fall just before air fares dramatically increase for the holiday season. There are many accommodations options in Honolulu. There are two dimensions to the tragedy Obama has inflicted on the American people. After rigorous study I have come to believe there is a compelling case that he is ineligible to serve as president. That’s the first tragedy: Americans were lulled into voting for a man who was not eligible to serve as president because they were betrayed by the mainstream media and Democratic Party.

(NEW YORK)(October 24, 2010) To take a line from Dr. Martin Luther King, “Barack Obama has been to the mountaintop.” In 2008. But that was then and this is now. Barack Obama never fooled me. But he fooled tens of millions of Americans. In two years, reality has set in.

Barack Obama is bankrupting our economy and endangering our national security. He may not be a “Manchurian Candidate” in the sense that he is an actual agent of our enemies. But he might as well be. The effect is the same. Obama is the enemy of the American people.

Saturday night (October 23rd) Saturday Night Live made fun of Obama’s missing birth certificate. Funny, but the missing birth certificate is not such a joke any more. What is Obama hiding? Even Saturday Night Live wants to know. [Remember, we will open Obamacon 2012 on November 9th in Honolulu, just a few days away.]

Watching Obama on the campaign trail this month made me reflect on my first column about Obama’s bogus life story. When I wrote about Obama in August, 2004 I felt very lonely. I was alone. It was not long before the mainstream media were smearing me; creepy-looking characters like Jim Rutenberg of the New York Times were scrounging around trying to find people to attack me.

Obama had a “smear squad” during everything they could to denigrate me. They are still at it in 2010.

Fox News used my research. And then stuck a fork in me.

But when you have survived wars and revolutions, as I have, you don’t scare easily. I kept telling the truth about Obama. “Just wait,” I said to myself. “Just wait.”

How sweet it is.

Obama has become a sad sight. He is like a boxer who has lost his punch, a quarterback who can’t throw. I once called him the “World’s Greatest Entertainer,” and he was. But he’s not so entertaining any more.

Obama is taking a sledgehammer to our health care system. He is subsidizing profligate spending by bankrupt state governments. He kowtows so low to the Chinese that they have to get down on the floor to see his forehead touching the floor. How about a new Broadway show: “Obama: The Man of La Manchus.”

As for the Muslims? Well, Imam Obama is am embarrassment to the Muslims as well as us. The “first Muslim president” turned out to be a loser. He may have groveled to Muslims, but they have growled back. “Is Iran afraid of Obama?” That could be a musical comedy on Broadway. Or a tragedy.

If Barack Obama stays in the White House, America will be bankrupt by the time he vacates the premises. His trillions of dollars of welfare spending, his deficits, his “reforms” and his “bankrupt” foreign policy are destroying a nation that was carefully built up over the past two centuries. Is this what Americans voted for in 2008? Obviously not.

I am amazed. Obama does more harm than good to Democrats. If Barry called me (Obama will always be "Barry” to me; I’ve been to Honolulu) I’d say “Bar, hide your face and keep your mouth shut. That’s the best way to help Democrats. Every time you pop up, you energize the American people to come out and vote against you.” Obama isn’t listening.

Obama is even dredging up his old 2008 lines. “Yes we can!” My response: “No you didn’t.” You borrowed more, spent more and taxed more in the first two years of your presidency than any predecessor in history. What do you have to show for it?

Obama may be tired, but obviously I’m not. We are still fighting for the facts and searching for the truth about Obama’s past. When I started out in 2004, I was the only American who doubted Barry’s opaque origins. Now nearly 100 million Americans have doubts about The Great Obama. My movement keeps growing; Obama’s keeps shrinking. Revenge is a dish best eaten cold.

Or if you prefer G-rated entertainment, this is a classic story of the tortoise and the hare. Obama may have tried to smear me in the short run, but in the long run I am taking him apart like a piece of fried chicken. I had a deeper, clearer picture of who Obama was, and who he was not, before anyone else. That is why Obama has attacked me so relentlessly. I tell the truth.

And I tell the truth about both parties: I may have been the first name on Barack Obama’s Enemies List; but I was also the first name on George Bush’s Enemies List. How’s that for bipartisanship?

Voters are not starry-eyed abut the Republican Party. Nosiree. Republicans have been equal partners in destroying our economy, so that a tiny sliver of Americans could get rich while almost all of us went into debt. Washington has made all of us victims of the robo-signers. Voters are casting votes against Obama, not for the Republican record from 2001-2007.

Republicans will be on probation. If they start up with the crazy legislation, and fail to take control of the budget, the Republican dynasty will last about as long as Obama’s. People that are losing their jobs and losing their homes want results, not promises. They want a fresh start, not a bunch of stale slogans.

Last week I outlined the serious challenges Obama faces in 2011. Well, let me be clear: they are our challenges. Our leaders may have made the mess, but we are the ones who are responsible for the cleanup. Obama may have run up the tab, but we get to pay the bill. Young Americans from the heartland are dying because of Obama’s mistakes. Tin pot dictators like Hamid Karzai are looting billions of American dollars for their own secret bank accounts. The Chinese junta is preparing to put the boot in Mr. Obama. As they said in “All About Eve,” “fasten your seat belts.”

My friend Uri Avnery in Tel Aviv suggested in his column this weekend that there is a whiff of fascism in Israel. Uri, if we don’t get our house in order there will be more than a whiff of fascism in America.

Fifty-five years ago I became a leader, quite by accident. I have been involved in leadership all of my life. I started with sports leadership and went on to military leadership, clandestine leadership, business leadership and political leadership. Obama was never a leader. In 2008 I said Obama was not a leader; he was an entertainer. And he was entertaining. But does anybody today doubt my 2008 analysis? (By the way, my leadership started a young boy on the path to becoming an All-State pitcher.)

In ten days the curtain is coming down on “Obama! The Musical” Barack Obama is going to have to face the music for the first time in his life. The lights will be going dark for Barack Obama on Broadway. Comedy, musical, drama, whatever, the show’s over.

Re: Lt. Col. Terry Lakin


Dear General Casey:

As the person whom left-wing media call the “King of the Birthers,” and as the writer who originally raised questions about President Barack Obama’s missing birth certificate and legal status, I would like to provide some independent information concerning the potential court martial of Lt. Col. Terry Lakin.

I am completely independent and impartial in so far as the Lakin matter is concerned. So far as I am aware I have not had any contact with anyone involved in Lakin’s specific case. I am the author of the Obama book “Obama: The Man Behind The Mask” which first raised questions about Obama’s citizenship.

The concepts which follow are complex. This letter is a summary or distillation of the issues and questions raised, and should not be considered an exhaustive discussion.

1. What is a “birther?”

The left-wing media have grouped together everyone who questions the circumstances concerning Barack Obama’s birth and citizenship as a “birther.” Obama’s original 1961 birth certificate is missing; Obama has refused to release it. I have a lawsuit pending in Hawai’i to open the state’s records. That’s why I am called the original or “King” birther.

Hawai’i officials are hiding something but I don’t quite know what.

Thus, because I believe Obama was actually born in Hawai’i, strictly speaking I am not a “birther.” Despite some criticism because I accept the birther term created by Obama’s media mujahideen, I think it is fair to say I triggered and created doubts about Obama’s birth and citizenship. As a form of shorthand I am a birther. Birther is a convenient way of expressing an uneasiness that concerns tens of millions of Americans.

In the absence of Obama’s real documentation, a large universe of fanciful argumentation has been created by some of Obama’s critics (not including me). There are persistent claims Obama was born in Kenya (fostered in part by Michelle Obama). I am constantly bombarded by persons who believe there is “evidence” for this assertion. I have seen no credible evidence Obama was born in Kenya.

2. Why you should proceed cautiously

You might be tempted to consider the “birther” controversy a diversion. As commander of the Army, you should not do so. Birther sentiments are concentrated in the states and communities where the Army receives most of its volunteers. In other words, you don't find a lot of Army people from Manhattan who are birthers, but then you don’t get a lot of soldiers from Manhattan either.

But birther sentiments are extremely strong across the south and west, where the bulk of the Army comes from. Thus, I would tread cautiously in wading into the birther brouhaha generated by Colonel Lakin. Making fun of the beliefs of families who provide the bulk of your soldiers is not a good idea.

3. Is Obama’s birth certificate really germane to Lakin’s claim?

While Obama’s 1961 birth certificate is of immense historical importance, that document is only peripherally necessary to a determination of Col. Lakin’s claim that the Commander in Chief needs to establish his legitimacy. (Obama’s document could potentially reflect a Kenyan or other foreign birth that was merely “certified” in Hawai’i. We don’t know.)

Nevertheless, by his own admission, President Obama is not eligible to hold the office of president.

While Obama did receive more votes than John McCain, Americans were slow to realize that Obama simply lacked the constitutional qualifications to serve as president. Please allow me to explain.

4. Why Obama is ineligible/the “natural born citizen” issue

A. Who is eligible to serve as president?

The Constitution has one additional and specific term
among the qualifications to serve as president. A president must be a “natural born citizen.” The term “natural born citizen” (“NBC”) is not defined in the Constitution itself, or anywhere else in contemporaneous American law at the time Constitution was adopted.

There seems to be agreement among legal scholars where the NBC term originated. John Jay sent George Washington a letter asking that a future commander in chief (“CIC”) be an NBC. That’s as far as scholarly agreement extends. It is important to note that no federal court has ever squarely confronted or clearly defined what NBC means. As one federal judge has stated, “the question is not completely free from doubt.” It is also a truism that most of the commentary on the NBC issue has come from “liberal,” not conservative, scholars and so we have not really had a full-throated debate on what NBC really means.

B. Does the term “NBC” have independent meaning?

While the term NBC did not have independent American meaning at the time of the Constitution itself, there was significant existing European literature that discussed and refined the term. Jay was a scholar and was probably aware of that writing. Thus, the founders can reasonably be presumed to have been aware of the significance of NBC term Jay requested be placed in the Constitution. That is why the “legislative history” is so sparse. They knew what they were talking about.

In a sort-of “search and avoid” mission we knew in Viet-Nam, liberal scholars recently have sought to “search” for the NBC term’s origins but “avert” their eyes from use of the term NBC in European literature during the second half of the eighteenth century. I believe they are “avoiding” European writings because these writing explain the term NBC in a way that liberal scholars do not want to concede.

The term NBC meant, and still means, someone who was not only born in a country but someone who had both of his parents as citizens of the country at the time of his or her birth. In other words, someone could not just come to this country and have a baby and have that person “grow up to be president” unless both of the parents of the future president were also citizens at the time of his or her birth. This heightened “test” explains why the special NBC words were inserted in the Constitution.

C. What were they afraid of?

There is scholarly agreement that at the time the Constitution was adopted, the founders were afraid of potential future Anglo-Germanic usurpation. In other words, they had a real fear which motivated them to ensure that the CIC met a much higher standard of qualification than mere citizenship. They wanted a CIC to have greater ties to this nation than mere presence on the land.

D. Why is Obama ineligible?

Obama is a U. S. Citizen and became one at birth. He is not and could not become an NBC. Why? What is the distinction? For over hundred years, U. S. Supreme Court precedent has accepted that anyone physically born in the United States is a citizen. But remember that the NBC requirement was obviously more than “mere citizenship,” because the term was inserted in the qualifications for only one office (president) while lesser offices (Senator and Representative) required only “citizenship.”

It is axiomatic that in using a specific and special term for the president, the founders meant to imbue the office with a greater test for qualification to serve.

Obama is ineligible by his own admission. He claims his father was Barack Hussein Obama (“BHO”) from Kenya. Ironically, Obama’s case illustrates exactly what the founders were trying to prevent: a drive-by president.
BHO had no ties to this country. He came here presumably on a student visa and very likely never even became a permanent resident. He left behind a Kenyan wife and children, and returned to them. Today we would call our president a “non-martial” offspring of BHO in preference to a harsher term in use at the time of Obama’s birth.

BHO had no ties to this country, yet through some process he deposited a “president” on our soil. That is exactly the type of tenuous connection to America that the founders thought should not permit someone to become president. They wanted to require a multi-generational presence as eligibility to serve as president.

So, by his own admission that his father was someone with no ties and no citizenship claims to this nation, Obama is ineligible to serve as president. He is the example that proves the rule and proves precisely what the founders were trying to prevent. BHO created the very “drive-by president” that the founders feared in adopting the NBC clause.

Ironically, I have advanced the theory that Obama’s real, or biological, father is Frank Marshall Davis. If my theory is correct, and only if my theory is correct, is Obama actually an NBC. Davis was indisputably an American citizen.

5. Prior litigation

There have been many lawsuits exploring the NBC issue. I predicted they would fail, and I was correct. I have over forty years of successful federal court litigation experience. But none of the cases involved a determination on the merits of the definition of NBC. Instead, judges dismissed lawsuits because the plaintiffs lacked “standing.” Standing is an artificial concept created by the judiciary to ensure that people litigate real claims instead of hypothetical disputes. Judges held that ordinary citizens could not challenge presidential election issues due to a lack of particularized injury, or standing.

However, Col. Lakin’s challenge to his commander in chief falls in an entirely different legal category, a fact hitherto ignored by both the media and the military. I think this is why you should proceed cautiously with Col. Lakin’s claims.

6. What makes Lakin’s claim unique, and substantial

Unlike a civilian court where an individual plaintiff may lack standing to challenge a government official’s eligibility to hold office, a military court martial is not a civilian court. Historically, a court martial is part of the military chain of command. Military discipline culminating in a court martial flows through the military system, not through an independent system of civil justice. Courts martial are the military.

Thus, while ordinary civilians may lack standing to challenge a commander’s qualifications, that is not true in the case of a military officer.

Col. Lakin is challenging the constitutional qualifications of his commanding officer. (Military law also allows an officer to challenge what may be invalid orders under the “Nuremberg" doctrine and similar modern concepts of military restraint and responsibility.) In my legal opinion, Lakin’s case lacks any indicia of criminal intent. In my legal opinion, Lakin clearly has standing to raise and proffer his concerns because unlike an ordinary civilian in a civil court, Lakin is an officer by Act of Congress. Lakin is in the direct chain of command with the president/commander.

Thus, while civilian judges could bar ordinary litigants, I don’t think that the military chain of command which culminates in President Obama can make a claim that an officer lacks standing to “stand up” to his commander.

In my legal opinion, the fact that Lakin is in the chain of command and is raising issues related to the legitimacy of the chain of command takes this case out of the prior legal cases that were unsuccessfully raised in the civil courts.

7. Where do we go from here?

A. Where do you go?

Because I am not part of the Lakin case I will refrain
from making specific recommendations. Nevertheless, because of the unique fact that Lakin's claim arises in the chain of command, his argument or demand cannot be dismissed as mere posturing. You have a real problem even if it is not the one which is framed by the media (the “missing birth certificate”).

Just as an aside, you might suggest to the president that he authorize me and other scholars to receive a copy of the 1961 Hawai'i birth certificate. That would help lift the cloud on his origins though not on his NBC status. Every little bit helps.

B. Where do we as a nation go?

The longer President Obama plays games with his origins and refuses to address the very serious questions that exist about his citizenship and eligibility, the greater will be the eventual reaction to his legerdemain.

The left-wing mainstream media have tried to make a joke of Obama’s missing birth certificate.

But the American public does not take the matter lightly.

There is a vast disconnect between media sentiment and public sentiment on this issue.

I will have more to say on how Obama can be removed in a future discussion. For now, I think it is essential that you adopt the public’s view, and not the media’s view, and treat Lakin’s issue of NBC status as a serious issue and not a joke for late-night comedians.

(NEW YORK)(May 25, 2010) ContrarianCommentary.com’s Executive Editor, Andy Martin, will hold a New York City news conference Wednesday, May 26th to issue his legal opinion that Barack Obama is not eligible to serve as President due to the fact he is not a “natural born citizen” by Obama’s own admission.

“During the past six years that I have studied Barack Obama the ‘natural born citizen’ issue has risen to paramount importance. Previously I have not expressed a definitive opinion. On Wednesday I will do so.

“My legal opinion and conclusion will be communicated to the U. S. Army and will, I believe, have a blockbuster impact on the Pentagon. Lt. Col. Terry Lakin has refused to go to Afghanistan on the basis that Barack Obama is not eligible to be president. While I will be acting ‘in’ Colonel Lakin’s case, I am not involved with Lakin's defense and my opinions are completely independent of the advice given by his attorneys.

“Nevertheless, the issues Lakin raises present two separate and independent questions: [1] Is Obama constitutionally eligible to be president? [2] What if he is not eligible? What happens next? Where does that leave Col. Lakin?

“My conclusion is that Barack Obama is not constitutionally eligible, by his own admission, to serve as president.

“I have been working up to this conclusion for approximately a year. This why I believe Obama operatives stole the tapes from my April, 2009 First National Conference on Barack Obama’s Missing Birth Certificate held in Washington, DC.

“I sketched out substantially the same views in our Second National Conference in December and I have been somewhat tardy to get that tape on the Internet. It’s coming.

“There has been a lot of confusion about Obama’s ‘birthplace,’ which is not marked anywhere in Hawai’i. Nevertheless, I did not want to rush to judgment. There have been numerous lawsuits over Obama’s eligibility. I predicted in advance that all of these cases would be dismissed, and they were. But none of them were dismissed on their constitutional merits. I have not been a part of any of any prior ‘eligibility’ litigation. I was not ready to issue a formal opinion.

“I do not plan to file a lawsuit after I issue my opinion on Wednesday. The only 'Obama' lawsuits I have pending are in Hawai’i. One case seeks to force Hawai’i to release Obama’s original, typewritten 1961 birth certificate. The other lawsuit seeks to compel Governor Linda Lingle to comply with Hawaii’s Uniform Information Procedures Act. That’s it for me.

“Our research team kept at it while I was in Hawai’i earlier this month. We have carefully analyzed the opinions and conclusions of others, both pro and con, as well as the underlying constitutional principles concerning [1] Obama’s eligibility [2] removal from office if he is ineligible.

“I am sure we will manage to present arguments and conclusions that will leave everyone unsatisfied. But that’s the nature of independent research and legal conclusions.

“Although Obama’s operatives call me the ‘King of the Birthers,’ and I accept that title, I am not in fact a ‘birther’ as the term is commonly understood. I am a ‘doubter.’ I believe that Obama was born in Hawai’i. Nevertheless, those Americans who have relentlessly demanded that Obama release his original Hawai’i birth certificate have performed a valuable public service. We are entitled to draw an ‘adverse inference’ from Obama’s refusal to produce the document.

“For myself, after exhaustive research, I still have not seen any credible evidence that Obama was born anywhere else but Hawai’i. But that ‘birth’ is only part of the ‘natural born citizen’ requirement and inquiry.

Martin, who has relentlessly pursued the public release of Barack Obama’s original, typewritten 1961 birth certificate, will hold a Honolulu news conference today, May 6th, to explain how his news conference on April 30th triggered the disclosure two days later by Governor Linda Lingle that she was behind 2008 reports that Barack Obama’s birth certificate was legitimate. Martin plans to accuse both Lingle and Hawai’i Department of Health Director Dr. Chiyome Fukino of deliberately deceiving the American people. Martin will hold his news conference outside the Governor’s office on the 5th floor of the Hawai’i State Capitol.

“It seems that every time I come to Honolulu and start investigating and litigating, some surprising new development takes place,” Martin says. “When I came to Honolulu in 2008, within hours Barack Obama suspended his campaign and followed me to Hawai’i. Was Obama possibly trying to stop me from interviewing his grandmother? After a judge set a hearing on the release of Obama’s birth certificate, in response to a lawsuit I had filed, Linda Lingle now admits that she secretly got Dr. Chiyome Fukino to falsely claim Fukino had acted alone in vouching for Obama’s hidden birth certificate on the eve of the 2008 election.

“Hawai’i officials are making a farce out of their stewardship of Obama’s original birth certificate,” Martin charges. “Last Friday I announced I would sue Lingle over her role in the ‘Birther Nation’ controversy. My threat to sue was prominently reported by Hawai’i media including MSNBC and the original source, the ABC affiliate in Honolulu:

Two days later, Lingle went on a friendly talk show and disclosed that it was Lingle, not Fukino, who had initiated a review of Obama’s birth certificate in 2008. Fukino had lied when she said 'No state official, including Governor Linda Lingle, has ever instructed…’ What was asking Fukino to go into the vault and ‘check the certificate,’ if not special attention? Does Lingle routinely check birth certificates? Why did Lingle conceal her role in 2008, and is only now confessing that in 2008 that she put Fukino up to hide Lingle’s role on the eve of the presidential election? Cover-up? Fraud? It’s all here.

“Yesterday I started writing a favorable column on Lingle. I believe she is an extraordinary woman, for whom I have the highest respect. But she has been as ham-handed as a Chicago alderman with her behind-the-scenes manipulation of Fukino.

“Lingle may have realized we were closing in on her ‘Hawai’i Five-0’-style and she decided to confess before we exposed her. The drama of her confessing 1-1/2 years later that it was Lingle, not Fukino, who initiated the birth certificate review and clandestinely directed Fukino to issue a statement supporting Obama, is high drama. These latest facts couldn’t even be a script on ‘Five-0;’ they are surreal: after becoming aware through KITV-TV that I was closing in on her, Lingle confessed. To a radio rabbi.

“Every time I come to Hawai’i, strange things start to happen. What’s next?” Martin will ask at his news conference. “Governor Lingle has refused to meet with me. Now I know why. She views me as a later-day McGarrett, relentlessly investigating Obama and single-mindedly pursuing the facts about Obama’s birth certificate. Only this time the ‘real’ governor is behind the fraud, whereas in Five-0 the fictional governor is committed to the truth. How’s that for a twist?

“It is high time Lingle released the secret birth certificate—the typewritten, 1961 document that she has repeatedly manipulated without allowing the public to see—before she is further embarrassed by her role in this growing scandal. It is time for Linda Lingle, now a self-confessed liar and fraudster, to stop deceiving the American people.

“Notwithstanding her abysmally poor judgment in the Obama matter, I continue to have the highest respect for the governor, and my column will run as written before I leave Honolulu later this week. We are planning a series of three portraits, of Lingle, candidate Charles Djou and former proto-Marxist congressman Neil Abercrombie.

“In closing, I must reject Lingle’s claim that Obama’s birth certificate issues are ‘distractions.’ Obama’s eligibility to hold the office of president, and the way Hawai’i officials have deliberately sought to confuse and mislead the American people, are not ‘distractions.’ They are one phase of a growing constitutional crisis.”
